Child Custody and Summer Vacation Plans

The summer is here, which means you might have some fun summer vacation plans in mind now that your children have a break from school. However, if you share custody with your ex, planning for a summer vacation can be a little more complicated than it is for most other families. To ensure your summer goes smoothly and that you do not end up wasting your days arguing and fighting over who gets to ...

Below are some tips on how to plan for your summer vacation with your children:

  • Set up a vacation schedule and be sure to stick to it: Both you and your ex are going to want to spend quality time with the children during the summer, so the best way to ensure you are both able to get the time you want, you will have to discuss your plans. Once you are able to create a vacation schedule you can both agree on, submit a signed copy of it to a family court judge. This will hold you both accountable for sticking to the schedule and help you both stay out of court for visitation or custody interference.
  • Make sure you are not violating the custody agreement: Of course, not all custody agreements are the same. Some might have geographical limits, prohibiting you from taking the kids out of the state or out of the country. Therefore, if you are planning a summer vacation outside of your custody agreement's geographical limits, you will need a modification that will allow you to travel abroad with your children.
  • Provide adequate notice: Even if you have the best and most detailed plans, they will not do you much good if you suddenly spring them on your ex at the last minute. Try to give your ex at least a two-month head's up about your plans. He or she will want to spend time with the children as well, so knowing your plans will help your ex make plans that do not conflict with yours, giving both parties a chance to have time with the kids during the summer break.
  • Exchange custody in a safe place: Child custody exchanges can be stressful, especially if you and your ex are not entirely comfortable with one another. To avoid making this situation more difficult than it needs to be, try meeting in a public place where your children can feel safe, such as a daycare facility.
  • Allow your kids to communicate with the other parent during their vacation: Just because this is your special time with the children does not mean you should ban communication between them and their other parent. There are several different ways you can allow them to maintain contact, including phone calls, text messaging, Skype, and emails. Remember, your kids might miss their other parent even while they are enjoying their vacation with you, so be considerate of everyone's needs.
