Relocation And Child Custody

California state law requires parents who share custody to inform the court if they plan to relocate with their child. The court will review the move and the reasons behind it to determine what is in the children's best interests. The court has the authority to approve or deny the move. Whether you are a parent who wants to relocate with your child or a parent who wants to prevent your child from moving, Westover Law Group can help. We have extensive experience in particularly difficult child custody cases.

Reasons For Relocation

The reasons for wanting to relocate your child will be one of the main determinates for approval. The parent wanting to move with their child must show that it will be beneficial for the child, as well as the adult.

Valid reasons for relocation can include:

  • To become closer to family and loved ones
  • A new job opportunity
  • Academic or extracurricular activities for the child
  • To move away from someone abusive or dangerous

The custodial parent must prove to the court that the move will be good for their child. Subsequently, if the other parent has fears that the relocation will place the child in danger or harm the child in anyway, the parent can bring these concerns to the court. The court will then decide whether or not to allow the relocation and what modifications must be made to the parenting plan.
