Types Of Custody

Judges in California understand the importance of preserving the relationship between child and parent. However, depending on the facts of the case, it may not always be possible for the parents to have equal parenting time, although that is often the goal.

Parents may also disagree about how they would like their child to be raised, leading to the need to bring the case to court. Following are two types of custody the court will award:

  • Legal custody: This is a parent’s right to contribute to or make important decisions regarding the child’s well-being, medical care, education and religious upbringing. Sole legal custody refers to when one parent is in charge of making these decisions. Joint legal custody means that both parents are involved, and is the typical court decision.
  • Physical custody: This refers to where the child will live, and with which parent. The custodial parent is the one who has custody, and the noncustodial parent will typically have visitation rights. The decision to grant physical custody is based on a variety of factors, such as the parents’ living arrangements, finances, work schedules and whether or not there was a history of domestic violence.

As a general rule, all judges render custody decisions based on “the child’s best interests” — in other words, whatever the judge believes will benefit the child most in the long-run. This decision will be made upon review of all the evidence.
